<br />. <br /> <br />. <br /> <br />3. The source of the water is Indiana Creek, tributary to <br />the Blue River. <br /> <br />4. The description of upstream and downstream points of <br />minimum stream flow reach claimed: The upstream point is the <br />confluence with an unnamed tributary at latitude 39025'13" <br />North and longitude 105058'58" West. The downstream point is <br />the confluence with Goose Pasture Tarn at latitude 39027'12" <br />North and longitude 106001'43" West. The total distance of <br />the instream flow reach is approximately 3.6 miles. <br /> <br />Administration: For the stream segments in an unsurveyed <br />area, the Division Engineer has determined for administrative <br />purposes that the approximate legal description of the instream <br />flow reach as protracted from U.S.G.S. mapping is as follows: <br />upstream point is the SW/4 SE/4 S22 T7S R77W 6th PM; downstream <br />point is the NW/4 SW/4 S8 T7S R77W 6th PM. <br /> <br />5. The use of the water is for in stream flows to preserve <br />the natural environment to a reasonable degree. <br /> <br />6. The date of initiation of appropriation is July 11, <br /> <br />1989. <br /> <br />7. The amount of water claimed is: 2.0 c.f.s. (April 1 - <br />September 30); 1.0 c.f.s. (October 1 - March 31), all absolute. <br /> <br />8. <br />11, 1989, <br />under the <br />(10) . <br /> <br />The water was first applied to beneficial use on July <br />by action of the Colorado Water Conservation Board <br />provisions of C.R.S. 37-92-102 (3), 37-92-103 (3), (4), <br /> <br />The Referee does therefore conclude that this application <br />should be granted, and an absolute decree for 2.0 c.f.s. (April 1 <br />- September 30); 1.0 c.f.s. (October 1 - March 31), is hereby <br />awarded for the purpose of maintaining an instream flow to pre- <br />serve the natural environment to a reasonable degree on Indiana <br />Creek between the upstream and downstream points as described in <br />paragraph 4 above, with appropriation date of July 11, 1989. The <br />applicant shall install and maintain such measuring devices and <br />maintain such records as the Division Engineer may require for <br />administration of this right. <br /> <br />9. Robin G. Theobald owns various water rights on Indiana <br />Creek in the stretch of the stream which is the subject of this <br />application. These rights are: <br /> <br />Goose Pasture Reservoir; appropriation date 8/31/1961 <br />Goose Pasture Reservoir 1st Enlargement; appropriation <br /> <br />-2- <br />
