Legal description of the streall) segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the <br />confluence of South Tallahassee Creek at <br />latitude 38031'38"N and longitude 105029'15" <br />W as the upstream terminus and extending to <br />the confluence of the Arkansas River at <br />latitude 38029'16"N and longitude 105022'48" <br />W as the downstream terminusr being a dis- <br />tance of approximately 8.5 miles. This <br />segment can be located on the Gribble <br />Mountain and McIntyre U.S.G.S. quadrangles <br />and is depicted on Exhibit A. <br /> <br />For the stream segments in an unsurveyed <br />area,the Division Engineer has determined <br />for administrative purposes that the approxi- <br />mate legal description of the instream flow <br />termini as protracted from U.S.G.S. and/or <br />U.S.F.S. mapping is as follows: upstream <br />terminus in the SE/4 NW/4, Sec 31, T17S, <br />R72W, 6th P.M.; downstream terminus in the <br />SW/4 SW/4, Sec 7, T18S, R71W, 6th P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 6, 1995. <br /> <br />7. The water was first applied to the above beneficial use <br />on November 6, 1995, by action of the Colorado Water Conservation <br />Board under the provision of C.R.S. ~~ 37-92-102(3), <br />37-92-103 (3), (4), (10). <br /> <br />8.
