7. This appropriation is made pursuant to C.R.S. 1973,
37-92-102(3) and 37-92-103(3) and (4). The purpose of
this appropriation by the state of Colorado is to insure
the preservation of a minimum stream level to protect
the natural environment 'to a reasonable degree.

8. The Applicant, by Stipulation, does not acknowledge
at this time any rights to water by the U.S.A., but in
the future if the U. S. A. shall seek appropriate judicial
determination of any claimed water rights in the watershed
involved herein, the Applicant stipulates and agrees
that its right shall be subject to any adjudicated'
senior right of the U.S.A.

9. The priority herein awarded said Trail Creek was filed in
the Water Court in the year of 1977 and shall be
administered as having been filed in that year; and shall
be junior to all priorities filed in previous year. As
between all rights, filed in the same calendar 'year,
priorities shall .be determined by historical dates of
appropriation and not affected by the date of entry of
ruling.
