Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the conflu- <br />ence of East Fork Dead Horse Creek and West <br />Fork Dead Horse Creek in the NE/4 SW/4, Sec. <br />19, T5S, R87W, 6th P.M. as the upstream ter- <br />minus and extending to the confluence of the <br />Colorado River in the NE/4 NE/4, Sec. 30, <br />T5S, R87W, 6th P.M. as the downstream termi- <br />nus, being a distance of approximately 0.8 <br />miles. This segment can be located on the <br />Shoshone U,S.G.S. quadrangle and is depicted <br />on Exhibit A, <br /> <br />5. Use of the water: <br /> <br />Instream flow to prese~ve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 26, 1996. <br /> <br />7. The water was first applied to the above beneficial use <br />on November 26, 1996, by action of the Colorado Water Conserva- <br />tion Board pursuant to the provisions of ~~ 37-92-102(3), and <br />37-92-103 (3), (4), and (10), 15 C,R.S, (1990 Repl. VoL), and <br />~ 37-,92-102 (4), 15 C.R.S, (1996 Supp,). <br /> <br />8, Amount of water claimed (ABSOLUTE): Instream flow of <br />all available unappropriated flows, <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of all available unappropriated flows is hereby entered to <br />preserve the natural environment to a reasonable degree through <br />the upstream and downstream points as described in paragraph 4 <br />above.
