The amount of water; <br /> <br />2 cubic feet per second <br />7. The use of the water: <br /> <br />This appropriation is made pursuant to C.R.S. 1973, <br />37-92-102(3) and 37-92-103(3) and (4). The purpose <br />of this appropriation by the state of Colorado is to <br />insure the preservation of a minimum stream level to <br />protect the natural environment to a reasonable degree. <br /> <br />, <br /> <br />8, The Applicant, by Stipulation, does not acknowledge at this <br />time any rights to water by the United States of America, <br />but in thp. future if the United States of America shall seek <br />appropriate judicial determination of any claimed water <br />rights in the watershed involved herein, the Applicant <br />stipulates and agrees that its right shall be sUbject to any <br />adjudicated senior right of the United States of America. <br /> <br />9. The priority herein awarded said Trial Creek was filed in <br />the Water court in the year of 1978 and shall be <br />administered as having been filed in that year; and shall be <br />junior to all priorities filed in previous years.
