<br />
<br />IN eUSTER AND PUEBLO COUNTIES

<br />Pursuant to Order of Referral filed and entered in the
<br />
<br />above case on May 17, 1976, the undersigned Water Referee,
<br />
<br />having investigated the matte~ of the application on file
<br />
<br />
<br />herein, hereby makes the foll~wing findings and ruling thereon:
<br />
<br />FINDINGS OF FACT
<br />
<br />L That the said applicati'on was filed on May 17, 1976.
<br />2. That the Water Clerk caused puPlication of such filing
<br />as provided by statute; that the time for filing Statements of
<br />Opposition expired on the last day of July, 1976, and that none
<br />
<br />has been filed.
<br />
<br />3. That the said application concerns a .stream located in
<br />
<br />Custer and Pueblo Counties, Colorado, and used for the maintenance
<br />
<br />of such minimum flows as are required to preserve the natural
<br />
<br />,environment to a reasonable degree.
<br />4. That the claims contained in the said application are
<br />
<br />made under the provisions of C.R.S. 1973, 37-92-102 (3) and
<br />
<br />37-92-103 (3), (4) and (10).
<br />
<br />5. That Applicant has furnished acceptable proof as to
<br />
<br />claims made.
<br />
<br />IT IS, THEREFORE, ORDERED AS FOLLOWS: That Applicant be,

<br />and is hereby, awarded an absolute surface wate~ right, to-wit:
