The natural stream channel from the confluence of Oil Creek at
latitude 380 50' 22" N and longitude 1050 10' 30 "Was the
upstream terminus and extending to the confluence of Hay Creek
in the SW/4 SW/4, Sec. 20, Tl4S, R70W, 6th P.M. as the
downstream terminus, being a distance of approximately 6.3 miles.
This segment can be located on the Cripple Creek North and
Wrights Reservoir U.S.G.S. quadrangles and is depicted on Exhibit
A.

5. Use of the water:

Instream flow to preserve the natural environment to a reasonable degree.

6. Date of initiation of appropriation:

November 6, 1995.

7. The water was first applied to the above beneficial use on November 6, 1995, by
action of the Colorado Water Conservation Board under the provision ofC.R.S. SS 37-92-102(3),
37-92-103(3), (4), (10).

8. Amount of water claimed (ABSOLUTE): Instream flow 00.50 c.f.s. (March 15 -
September 14); 1.50 c.f.s. (September 15 -March 14).

THE WATER REFEREE RULES:

The application is granted and a decree (ABSOLUTE) in the amount 00.50 c.f.s. (March
15 - September 14); 1.50 c.f.s. (September 15 - March 14) is hereby entered to preserve the
natural environment to a reasonable degree through the upstream and downstream points as de-
scribed in paragraph 4. The appropriation date for this water right is November 6,1995.

The priority herein awarded was filed in the water court in the year of 1995 and shall be junior
to all priorities filed in previous years. As between all rights filed in the same calendar year,
priorities shall be determined by historical date of appropriation and not affected by the date of
