Case No. 80 CW2l8 <br />Page 2 <br />Colorado Water <br /> <br />1 <br /> <br />10. <br /> <br />3. <br /> <br />The legal description of the structure: <br /> <br />The natural stream channel from headwaters in <br />vicinity of NE~SW~, Section 19, Township II South, <br />Range 70 West of the,6th P.M., Teller County, at a <br />point approximately 2500 feet North and 2400 feet <br />East of the SW Corner, Section 19, as the upstream <br />terminus, and the confluence of Turkey Creek at <br />latitude 39009'2Q,'' North, longitude 105015'47" West. <br />This area is not surveyed but it appears to be in the <br />NW~NE~, Section 30, Township lO South, Range 70 West <br />of the 6th P.M. as the downstream terminus, being a <br />distance of approximately 6.4 miles. <br /> <br />4. The source of water: <br /> <br />Little Turkey Creek <br />5. The date of appropriation: <br /> <br />May 7, 1980 <br /> <br />6. The amount of water: <br /> <br />1.0 cubic feet per second <br /> <br />7. <br /> <br />The use of the water: <br /> <br />To maintain such minimum flows as are required to <br />preserve the natural environment to a reasonable degree <br />pursuant to C.R.S. 1973, 37-92-l02 and l03. No diversion <br />of the water right herein will be made from the natural <br />stream channel. <br /> <br />8. <br />9. <br /> <br />The stipulation with the U.S.A. is incorporated by reference. <br /> <br />IT IS FURTHER ORDERED that the applicant shall install and <br />maintain such water measurement devices, recording devices, <br />content gauges and inlet and outlet measurement and recording <br />devices, as the case may be, as are deemed essential by the <br />Office of the State Engineer, and that the same shall be <br />installed and operated in accordance with instructions from <br />said office. <br /> <br />The priority herein awarded said Little Turkey Creek was <br />filed in the Water Court in the year of 1980 and shall be <br />administered as having been filed in that year; and shall <br />be junior to all priorities filed in previous years. As <br />between all rights, filed in the same calendar year, <br />priorities shall be determined by historical dates of <br />appropriation and not affected by the date of entry of <br />ruling. <br />
