<br /> <br />4. <br />claimed: <br /> <br />Legal description of the stream segment through which an instream flow is <br /> <br /> <br />, <br />., <br /> <br />2. <br /> <br />The name of stream involved: <br />Bear Creek (instream flow) <br /> <br />3. <br /> <br />The source of the water is: Bear Creek <br /> <br />a. The natural stream channel from the headwaters of Bear Creek at <br />latitude 370 52' 54'" N and longitude 107049' 3 \" W as the upstream <br />terminus and extending to the San Miguel River at latitude 370 56' 05" <br />N and longitude 1070 48' 12" W as the downstream terminus, being a <br />distance of approximately 4.2 miles. This segment can be located on <br />the Telluride U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = NW NW S 6 T42N R8W NMPM <br />126' East of West Section Line 59' South of North Section Line <br />UTM 4196440 N 251519 E (unsurveyed area) Zone 13 <br />Lower Terminus = SE SE S 23 T42N R9W NMPM <br />796' West of East Section Line 540' North of South Section Line <br />UTM 4202278N 253624E (unsurveyed area) Zone 13 <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25,2005. <br /> <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of CR.S. <br />~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 4.2 cfs (May 15 <br />- Aug. 14) and 2.0 cfs (Aug. 15 - May 14). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 4.2 cfs <br />(May 15 - Aug. 14) and 2.0 cfs (Aug. 15 - May 14) is hereby entered to preserve the <br />natural environment to a reasonable degree through the stream segment described in <br />paragraph 4 above. The appropriation date for this water right is January 25,2005. <br /> <br /> <br />The priority herein awarded was filed in the water court in the year of 2005 and <br />shall be junior to all priorities filed in previous years. As between all rights tiled in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not atTected by the date of entry of ruling. The Applicant shall install and maintain such <br /> <br />.. <br />
