Date of initiation of appropriation: September 9, 1980,
by final approval of,the Colorado Water Conservation Board at
its general meeting.

Amount of water claimed: (3 -.May 1 through September 30;
W - Ocotber 1 through April 30)

This appropriation is made pursuant to the provisions of
C.R.S. 1973, 37-92-102(3) and 37-92-103(3)(4) and (10) known
as Senate bill 97. The purpose of this appropriation by the state
of Colorado 1s to insure the' p~'eservatlon of a minimum stream
,level to protect the natural envl:r;>onment to a "reas'onable degree.'

RULING

IT IS THE RULING OF THE REFEREE that no adverse effect can
be determined and that BRUSH CREEK, as above described, is
APPROVED AND GRANTED AN ABSOLUTE IN PLACE DECREE in the amount
of 6.0 c.f.s. of water when and if it is available 1n the natural
flow, for the purposes of protecting the natural environment
thereof. As of the date of appropriation, September 9, 1980.
