Amount of water approoriated: 40.0 c,f.s, <br />ABSOLUTE (May 1 - August 31); 20.0 c.f.s. ABSOLUTE <br />(September 1 - April 30) . <br /> <br />d. Aooropriation date: November 27, 1990. The <br />appropriation was initiated and water first put to <br />beneficial use on November 27, 1990, by action of <br />the Colorado Water Conservation Board under ~~ 37- <br />92-102 (3), 103 (3), 103 (4), and 103 (10), C.R,S. <br />(1990 Repl. Vol. 15). <br /> <br />e, Use of Water: For Instream Flows to preserve <br />the natural environment to a reasonable degree, <br /> <br />4. Proposed terms and conditions:. The following shall <br />be the terms and conditions of th~s decree: <br /> <br />a. The Colorado-Big Thompson Project has water <br />rights with a priority date of August 1, 1935, for <br />the diversion of water by direct flow, storage, and <br />exchange as specified in Senate Document 80 and <br />decreed in Consolidated Case Nos. 2782, 5016 and <br />5017, United States District Court, District of <br />Colorado and that these water rights are senior to <br />the ewCB's Instream Flow water right described <br /> <br />- !.,.-,~....... <br />....o.J~..... <br /> <br />i~ ~a~?gr~r~ 3; <br /> <br />b. Releases from Granby Reservoir are made <br />pursuant to the "Principles to govern the Release <br />of Water at Granby Dam to provide Fishery Flows <br />immediately downstream in the Colorado 'River" dated <br />January 19, 1961; <br /> <br />c. The operation of the Colorado-Big Thompson <br />Project in accordance with Senate Document 80, the <br />decrees and Stipulations in Consolidated Cases, and <br />the "Principles to govern the Release of Water at <br />Granby Dam to provide Fishery Flows immediately <br />downstream in the Colorado River" dated January 19, <br />1961, may result in stream flows which are <br />insufficient to satisfy the ("filCD's In:;treu.in Flow <br />water right described above in paragraph 3; <br /> <br />d.
