<br />2. <br /> <br />The name of stream involved: <br />West Antelope Creek (instream flow) <br /> <br />3. <br /> <br />The source of the water is: West Antelope Creek <br /> <br />4. <br />claimed: <br /> <br />Legal description of the stream segment through which an instream flow is <br /> <br />a. The natural stream channel at the headwaters of the Gunnison River at <br />latitude 38039' 45"N and longitude 1070 03' 23"W as the upstream <br />terminus and extending to the Dooley Antelope Irrigation Ditch at <br />latitude 380 34' 48"N and longitude 106058' 51"W as the downstream <br />terminus, being a distance of approximately 7.8 miles. This segment can <br />be located on the Squirrel Creek, McIntosh Mountain, and Gunnison <br />U.s.G.S. quadrangles. <br /> <br />b. For administrative purposes only: <br />Upper Terminus = UTM 42 81126N 13 3 21 071E <br />Lower Terminus =NE SW S2l T50N RIWNMPM <br />UTM 4271 818N 13 227 443E <br />1475' East of West Section Line, 2300' North of South Section Line <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 28, 2004 <br /> <br />7. The water was first applied to the above beneficial use on January 28, 2004, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Insteam flow of 1.65 cfs (April 1 <br />- August 31), 1.20 cfs (September 1 - January 14), and 1.10 cfs (January 15- March 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 1.65 cfs <br />(April 1 - August 31), 1.20 cfs (September 1 - January 14), and 1.10 cfs (January 15- <br />March 31) is hereby entered to preserve the natural environment to a reasonable degree <br />through the stream segment described in paragraph 4 above. The appropriation date for <br />this water right is January 28, 2004. <br />
