<br />. <br /> <br />. <br /> <br />~ <br /> <br />92CW54 <br />CWCB RULING/DECREE (SILVER CREEK) <br />PAGE TWO <br /> <br />terminus of said natural channel at the confluence with South <br />Fork Michigan River located at Latitude 40 degrees, 28 <br />minutes, 54 seconds North, and Longitude 106 degrees, 00 <br />minutes, 26 seconds West, Jackson County, Colorado; said <br />segment being 6.9 miles more or less. <br /> <br />Administration: For the stream segments in an unsurveyed area, <br />the Division Engineer has determined for admin~strative <br />pUrPOses that the approximate legal description of the minimum <br />stream flow termini as protracted from U.S.G.S. mapping is as <br />follows: upstream terminus in the Southwest 1/4 of section 34, <br />T6N, R76W of the 6th P.M., Jackson County, Colorado; <br />downstream terminus in the Northwest 1/4 of Section 23, T6N, <br />R77W of the 6th P.M., Jackson County, Colorado. <br /> <br />4. The source of the water is: <br /> <br />Silver creek, tributary to South Fork Michigan River, <br />tributary to Michigan River, tributary to North Platte River. <br /> <br />5. The date of appropriation is: <br /> <br />May 8, 1992. <br /> <br />6. The appropriation was initiated by: <br /> <br />Colorado Water Conservation Board action pursuant to C.R.S. <br />37-92-102(3) and 37-92-103(3), (4), and (10). <br /> <br />7. The water was applied to beneficial use on: <br /> <br />May 8, 1992. <br /> <br />8. The amount of water awarded is: <br /> <br />3.0 cfs, Absolute, from April 16 through October 15, each <br />year; and 1.0 cfs, Absolute, from October 16 through April 15, <br />each year. <br /> <br />9. The use of water is: <br /> <br />Minimum stream flow to preserve the environment to a <br />reasonable degree. <br /> <br />10. Applicant shall not oppose, object to, or protest a change in <br />point of diversion of an absolute water right upstream from its <br />decreed point of diversion to a new point of diversion within the <br />reach of the minimum stream flow decree applied for, when the owner <br />of such water right (a) is entitled to extend the head of such <br />
