Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the confluence of Royal <br />Gulch in the vicinity of latitude 37057'02"N and <br />longitude 106023'26"W as the upstream terminus and <br />extending to the confluence of Carnero Creek at lati- <br />tude 37054'16"N and longitude 106023'25"W as the down- <br />stream terminus, being a distance of approximately 3.3 <br />miles. This segment can be located on the Lookout <br />Mountain U.S.G.S. quadrangle and is depicted on Exhibit <br />A. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the NE/4 NW/4, Sec. 26, T43N, R5E, N.M.P.M.; . <br />downstream terminus in the SW/4 NE/4, Sec. 11, T42N, <br />R5E, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The Colorado Water Conservation Board first applied the <br />water to the above beneficial use on March 9, 1994, under the <br />provisions of C.R.S. (1990) !l!l 37-92-102 (3) , <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): <br />0.50 c.f.s (April 1 - October 15); 0.25 c,f.s. <br />March 31) . <br /> <br />Instream flow of <br />(October 16 - <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 0,50 c.f.s. (April 1 - October 15); 0.25 c.f.s. (Octo- <br />ber 16 - March 31) is entered to preserve the natural environment <br />to a reasonable degree through the upstream and downstream points <br />as described in paragraph 4 above. The appropriation date for <br />this water right is March 9, 1994. <br />
