Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />'The natural stream channel from an unnamed lake <br />at latitude 39035'47"N and longitude 105038'15"W as the <br />upstream terminus and extending to the confluence of <br />Beartrack Creek at latitude 39035'56"N and longitude <br />105034'25"W as the downstream terminus, being a dis- <br />tance of approximately 3.8 miles. This segment can be <br />located on the Mount Evans and Harris Park U.S.G.S. <br />quadrangles. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SW/4 SE/4, Sec. 23, T5S, R74W, 6th P.M., 250 <br />feet from the South line and 1,470 feet from the East <br />line; downstream terminus in the SW/4 SW/4, Sec. 21, <br />T5S, R73W, 6th P.M., 1,000 feet from the South line and <br />500 feet from the West line. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 13, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on September 13, 1994, by action of the Colorado Water Conserva- <br />tion Board under the provision of C.R.S. (1990) ~~ 37-92-10~(3), <br />37-92-103 (3), (4), and (10). . <br /> <br />8. Amount of water claimed (ABSOLUTE): <br />6.5 c.f.s. (May 1 - September 30); 2.5 c.f.s. <br />30) . <br /> <br />Instream flow of <br />(October 1 - April <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 6.5 c.f.s. (May 1 - September 30); 2.5 c.f.s. (October <br />1 - April 30) is entered to preserve the natural environment to a <br />reasonable degree through the upstream and downstream points as <br />described in paragraph 4 above.
