The source of the water is: <br /> <br />North Clear Creek, tributary to Clear Creek, tributary <br />to the Rio Grande. <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the headwa- <br />ters in the vicinity of latitude 37048'52"N <br />and longitude 107019'22"W as the upstream <br />terminus and extending to the U.S.F.S Bound- <br />ary in the NW/4 SW/4, Sec. 11, T41N, R4W, <br />N.M.P.M., as the downstream terminus, being a <br />distance of approximately 2.3 miles. This <br />segment can be located on the Finger Mesa <br />U.S.G.S. quadrangle. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the NE/4 NE/4, Sec. 17, T41N, R4W, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on March 9, 1994, by action of the Colorado Water Conservation <br />Board under the provision of C.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): <br />3.5 c.f.s.
