Legal description of the stream segment through which an instream <br />flow is claimed: <br /> <br />The outlet of an unnamed lake at latitude 37049' 42"N and longitude 1070 <br />48' 25"W as the upstream terminus and extending to the confluence of <br />Howard's Fork San Miguel River at latitude 370 51' 18"N and longitude <br />1 070 48' II "W as the downstream tenninus, being a distance of <br />approximately 2.2 miles. This segment can be located on the Ophir U.S.O.s. <br />quadrangle. <br /> <br />5. Use of water: <br /> <br />Instream flow to preserve the natural environment to a reasonable <br />degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />Janl\ary 23, 2002. <br /> <br />7. The water was first applied to the above beneficial use on January 23, <br />2002, by action of the Colorado Water Conservation Board under the <br />provision ofC.R.S. S ~ 37-92-102(3),37-92-103(3), (4), (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow 00.0 cfs (May <br />I-August 14); 1.4 cfs (August 15 - October 14); 0.9 cfs (October 15- <br />April 30). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The Application is granted and a decree in the amount of (ABSOLUTE) <br />Instream flow of3.0 cfs (May I - August 14); lA cfs (August IS - October 14); 0.9 cfs <br />(October 15 - April 30) is hereby entered to preserve the natural environment to a <br />reasonable degree through the upstream and downstream points as described in <br />paragraph 4 above. The appropriation date for this water right is January 23, 2002. <br />
