<br />,. <br /> <br />c, <br /> <br />. <br /> <br />. <br /> <br />IT IS, THEREFORE, ORDERED AS FOLLOWS: That Applicant <br />be, and is hereby, awarded an absolute surface water right, <br />to-wit: <br /> <br />NAME AND ADDRESS: Colorado Water Conservation Board <br />1313 Sherman Street, 8th Floor <br />Denver, Colorado 80203 <br /> <br />WATER RIGHT <br /> <br />NAME OF STREAM: Tennessee Creek. <br /> <br />LOCATION OF POINT OF DIVERSION: The natural stream channel <br />trom contluence West Tennessee Creek in the NW1!4 of Section <br />22, Township 8 South, Range 80 West of the 6th P.M. in Lake <br />County, Colorado, as the upstream terminus and confluence <br />with Longs Gulch at Latitude 390 19'01" North Longitude <br />1060 20'23" West as the downstream terminus, being a <br />distance of approximately 2.4 miles. This segment can <br />be located on the Leadville North U.S.G.S. quadrangle. <br /> <br />SOURCE OF WATER: Stream as described. <br /> <br />PRIORITY DATE: June 3, 1982, provided, however that this <br />rlght shall be junior to all priorities awarded in cases <br />filed prior to 1982, and otherwise junior as provided in <br />CRS 1973, 37-92-306. <br /> <br />AMOUNT OF WATER: 5 c.f.s. <br /> <br />USE OF WATER: To insure the preservation of a mlnlmum stream <br />level to protect the natural environment to a reasonable degree. <br /> <br />IT IS FURTHER ORDERED That the appropriation herein shall <br />be subject to the present uses or exchanges of water being made <br />by other water users pursuant to appropriation or practices in <br />existence on Tennessee Creek on June 3, 1982, whether or not <br />previously confirmed by court order or decree. <br /> <br />IT IS FURTHER ORDERED That Applicant shall install and <br />maintain such water measurement devices, recording devices, <br />content gauges and inlet and outlet measurement and recording <br />devices, as the case may be, as are deemed essential by the <br />Office of the State Engineer, and the same shall be installed <br />and operated in accordance with instructions from said Office. <br /> <br />I <br />~, <br />\ <br /> <br />Page 2, Ruling of Referee 82CWl43 <br /> <br />-;1 <br />
