<br />CjY?OJ ,3EJ5 <br /> <br />the Water Referee for Water Division No. 5 In accordance with the <br />provisions ofC.R.S. S 37-92-101, et seq. <br /> <br />Timely and adequate notice of this proceeding has been given in the manner <br />required by law. The Court has jurisdiction over the subject matter of this <br />proceeding and over all who have standing to appear as parties, whether they <br />have appeared or not. <br /> <br />b. Statements of Opposition: A Statement of Opposition was filed by <br />Pratt Management Company, LLC. No other Statements of Opposition have <br />been filed and the time for filing such statements has now expired. <br /> <br />c. Summary of Consultation: On March 25, 1999, the Division <br />Engineer for Water Division No.5 submitted a Surrunary of Consultation <br />stating that the Application appears to be adequate and recommending that <br />the Application should be issued by the Referee as a ruling. The Referee has <br />given this recommendation due consideration. <br /> <br />d. Resolution of Statements of Opposition: The party filing a <br />Statement of Opposition has approved the terms contained herein. <br /> <br />3. Requested Water Right: ,The CWCB appropriated the lnstream Flow more <br />fully described as follows: <br /> <br />a. Source: The source of the water is Muddy Creek. <br /> <br />b. Location: Legal description of the stream segment through which an <br />instream flow is claimed: The natural stream channel from the outlet of <br />Wolford Mountain Reservoir in the SW NE, S25, TIN, R81W, 6th PM as <br />the upstream terminus and extending to the headgate of Deberard Ditch in <br />the NE SE, S7, TIN, R80W, 6th PM as the downstream terminus, being a <br />distance of approximately 9 miles. This segment can be located on the <br />Kremmling V.S.O.S. quadrangle. <br /> <br />c. Amount of water appropriated: Instream flow of 105 cfs (May 15 - <br />June 30); 70 cfs (July 1 - July 14); 20 cfs (July 15 - April 30); 70 cfs (May 1 <br />- May 14), ABSOLUTE. <br /> <br />d. Appropriation date: July 13, 1998. The appropriation was initiated <br />and water first put to beneficial use on July 13, 1998, by action of the <br />Colorado Water Conservation Board under SS 37-92-102(3), 103(3), 103(4), <br />and 103(10), C.R.S. <br /> <br />2 <br />
