<br /> <br />3. The CWCB agrees to purchase streamflow measuring devices capable of measuring low <br />flows in Fourmile Creek in the vicinity of Crisman Gulch and in the vicinity of the intersection of <br />Founnile Creek and Wall Street to detennine the availability of water in Fourmile Creek to assist in the <br />administration of the instream flow decreed herein. The District agrees to install, maintain and operate <br />said measuring devices, and to report the infonnation from such measuring devices to the Division <br />Engineer. Additionally, the District agrees to make infonnation regarding the streamflow at the District's <br />points of diversion on Fourmile Creek available to the CWCB upon reasonable requests. If it becomes <br />necessary to repair or replace the measuring devices, the CWCB and the District shall discuss repair and <br />replacment at that time. <br /> <br />4. The CWCB shall obtain easements for the measuring devices if necessary and shall be <br />responsible for any costs associated with such easements. It is anticipated that costs associated with any <br />easements will be negligible. However, if such costs exceed $2,000 (two thousand dollars), the CWCB <br />and the District agree to work together to seek alternatives concerning location of the measuring devices. <br /> <br />5. The tenns of this stipulation shall be enforceable as a contract between the parties and as <br />a decree of the court in this case, and this stipulation shall be incorporated by reference into the decree in <br />this case. The terms in this stipulation are the result of a negotiated settlement between the CWCB and the <br />District and are not precedential and shall not be binding on the CWCB or the Di.strict in any other water <br />rights applications. <br /> <br />6.
