4. Legal description of the upstream and downstream points of
minimum stream flow reach claimed:

Legal description of the stream segment through
which an instream flow is claimed: The natural
stream channel from the confluence with the
North Fork Big Thompson River at latitude
40025'56" North and longitude 105020'18" West
as the upstream terminus and extending to the
juncture with the Idylwild Pipeline Diversion
at latitude 40025'44" North and longitude
l05018'42" West as the downstream terminus be-
ing a distance of approximately 1.5 miles.
This segment can be located on the Drake
U.S.G.5. quadrangle.

Administration: For the stream segment in an
unsurveyed area, the Division Engineer has de-
termined for administrative purposes that the
approximate legal description of the instream
flow termini as protracted from U.S.G.5. map-
ping is as follows: upstream terminus in the
NE/4, NW/4, section 3, T5N, R71W, 6th P.M.,
downstream terminus in the SE/4, NE/4, section
2, T5N, R71W, 6th P.M.

5. Use of the water:

Instream flows to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

November 14, 1989

7. The water was first applied to the above beneficial use on
November 14, 1989 by action of the Colorado Water Conserva-
tion Board under the provisions of C.R.S. 37-92-102(3),
37-92-103(3), (4), (10).

8. Amount of water claimed:

50.0 c.f.s; (May 1 through Oct. 3l), 20.0 c.f.s. (Nov. 1
through April 30), all absolute.

9. The Referee rules that this appl~cation should be granted
and an absolute decree for 50.0 c.f.s. (May 1 through Oct.
31) and 20.0 c.f.s. (Nov. 1 through April 30), is hereby
