Legal description of the upstream and downstream points of <br />minimum stream flow reach claimed: <br /> <br />Legal description of the stream segment through <br />which an instream flow is claimed: The natural <br />stream channel from the confluence with the <br />North Fork Big Thompson River at latitude <br />40025'56" North and longitude 105020'18" West <br />as the upstream terminus and extending to the <br />juncture with the Idylwild Pipeline Diversion <br />at latitude 40025'44" North and longitude <br />l05018'42" West as the downstream terminus be- <br />ing a distance of approximately 1.5 miles. <br />This segment can be located on the Drake <br />U.S.G.5. quadrangle. <br /> <br />Administration: For the stream segment in an <br />unsurveyed area, the Division Engineer has de- <br />termined for administrative purposes that the <br />approximate legal description of the instream <br />flow termini as protracted from U.S.G.5. map- <br />ping is as follows: upstream terminus in the <br />NE/4, NW/4, section 3, T5N, R71W, 6th P.M., <br />downstream terminus in the SE/4, NE/4, section <br />2, T5N, R71W, 6th P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flows to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 14, 1989 <br /> <br />7. The water was first applied to the above beneficial use on <br />November 14, 1989 by action of the Colorado Water Conserva- <br />tion Board under the provisions of C.R.S. 37-92-102(3), <br />37-92-103(3), (4), (10). <br /> <br />8. Amount of water claimed: <br /> <br />50.0 c.f.s; (May 1 through Oct. 3l), 20.0 c.f.s. (Nov. 1 <br />through April 30), all absolute. <br /> <br />9. The Referee rules that this appl~cation should be granted <br />and an absolute decree for 50.0 c.f.s. (May 1 through Oct. <br />31) and 20.0 c.f.s.
