c. There is no point of diversion as such.
and none is claimed. The minimum stream flow right claimed
is in the watershed of the Rio Grande, from its headwaters
in vicinity of lat. 37 deg. 32'32" N, long. 106 deg. 51'16"
W as the upstream terminus and Big Meadow Reservoir at lat.
37 deg. 32'16" N. long. 106 deg. 48'18" W as the downstream
terminus. being a distance of approximately 2.9 miles.
This segment can be located on the Spar City 15' U.S.G.S.
quadrangle.

d. There is no means of diversion, the claim
being to a minimum stream flow of 1.5 cubic feet/second of
water per second of time, In place in the stream bed.

e. The date of initiation of suCh appropria-
tion pursuant to the action of applicant under the provision
of C.R.S. 1973, 37-92-102(3), and 37-92-103(3), (4) and
(10) is July 8, 1980, on which date the water of said stream
was first applied to beneficial use to maintain the minimum
stream flow required to preserve the natural environment to
a reasonable degree.

f. That applicant is entitled to an absolute
in place minimum stream flow water right for such beneficial
use with a priority date of July 8, 1980.

THEREFORE, IT IS RULED AND ORDERED that the application
herein be and It Is hereby granted, and that applicant is
awarded an absolute in place minimum stream flow water right
for 1.5 cubic feet/foot of water per second of time In Black
Creek, with a priority date of July 8, 1980 for the purpose
of maintaining the minimum stream flow as required to pre-
serve the natural environment to a reasonable degree, uncon-
ditionally, subject, however, to all priority rights of '
senior appropriators of water in the affected watershed.
