'Filed: November 13, 1980 <br /> <br />No opposition'has been filed. <br /> <br />FINDING OF FACT <br /> <br />The DEER CREEK is a natural stream, tributary to the <br />Gunnison River in Hinsdale County and in old \,ater District <br />No. 62. <br /> <br />Legal description of beginning and end points of minimum <br />stream flow claimed: The natural stream channel from headwaters <br />in vicinity of lat 38001'40" north long 10701J'52" west as the <br />upstream terminus ,and conn Mill Creek lat 38 01' 21" north long <br />107010'26" west as the downstream terminus, being a distance of <br />approximately 3.4 miles. This segment cah be located on the <br />Cannibal Plateau U.S.O.S. quadrangle. ' <br /> <br />Date of initIation of appropriation: September 9, 1980, <br />by final approval of the Colorado Water Conservation Board at <br />its general meeting. <br /> <br />Amount of water claimed: (S - May 1 through September 30; <br />October 1 through April 30) <br />A. (Stream only) Flow in C.F.S.: 1.5 cfs. <br /> <br />W - <br /> <br />This appropriation is made pursuant to the provisions of <br />C.R.S. 1973, 37-92-102(3) and 37-92-103(3)(4) and (10) known <br />as Senate bill 97. The purpose of this appropriation by the <br />state of Colorado is to insure the preservation of a minimum <br />stream level to protect the natural environment to a reaonable <br />degree. <br /> <br />R U L I N G <br /> <br />, IT IS THE RULING OF THE REFEREE that hO adverse effect can <br />be determined and that DEER CREEK, as above described, is APPROVED <br />AND GRANTED AN ABSOLUTE IN PLACE DECREE ih the amount of 1.5 <br />c.f.s. of water when and if it is available in the natural <br />fIe"l,' for the purposes of protecting the natural environment <br />thereof.
