Location: <br /> <br />Legal description of the stream segment through which an <br />instream flow is claimed: The natural stream channel from <br />headwaters at a natural lake at lat. 39 deg. 25'23"N, long. <br />106 deg. 06'32"W as the upstream terminus and -extending to <br />the confluence with the Blue River at lat. 39 deg. 26'32"N, <br />long. 106 deg. 02'13"W as the downstream terminus, being a <br />distance of approximately 3.4 miles. This segment can be <br />located on the Breckenridge U.S.G.S. quadrangle(s). <br /> <br />For administrative purposes only, the Division Engineer for <br />Water Division 5 has translated the segment thus described <br />into approximate protracted section, township, and range <br />locations from U.S.G.S. mapping as follows: Upstream <br />terminus in the SE/4 SE/4 S2l T7S R78W 6th P.M., more spe- <br />cifically at a point whence the NE corner of S2 T7S R98W <br />bears S29 30W a distance of 22,975 ft.; downstream terminus <br />in the NW/4 SE/4 S18 T7S R77W 6th P.M., more specifically <br />at a point whence the NW corner of S7 T7S R77W bears S24 <br />30E a distance of 8,750 ft. <br /> <br />c. (l) Date of initiation of appropriation: November 8, <br />1985. <br /> <br />(2) Date water applied to beneficial use: Water was first <br />applied to beneficial use on November 8, 1985, pursuant to <br />S 37-92-l03(4}, C.R.S. (1973). <br /> <br />(3) How appropriation was initiated: By applicant's <br />approval of its staff's final recommendations at a regu- <br />larly scheduled meeting, subsequent to having requested and <br />considered recommendations from the Division of Wildlife, <br />and the Division of Parks and Outdoor Recreation. <br /> <br />d. Amount of water claimed: <br /> <br />Instream flow of 2.0 c.f.s. (Apr. 1 through Sept. 30); 0.5 <br />c.f.s. (Oct. 1 through Mar. 31), absolute. <br /> <br />9.a.
