<br />. <br /> <br />. <br /> <br />~ <br /> <br />DISTRICT COURT, WATER DIVISION 3, COLORADO <br />Cases No. 89CW22, 89CW23, and 89CW24 <br /> <br />STIPULATION <br /> <br />CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE <br />COLORADO WATER CONSERVATION BOARD, <br /> <br />IN SAGUACHE COUNTY, COLORADO <br /> <br />The Applicant, the Colorado Water Conservation Beard (the <br />"Board"), by and through its attorney, Duane Woodard, Attorney <br />General for the State of Colorado, and the Objector, American <br />Water Development, Inc., ("American Water"), by and through its <br />attorneys, Saunders, Snyder, Ross' Dickson, P.C., hereby <br />stipulate and agree as follows: <br /> <br />1. On May 31, 1989, the Board filed the applications in <br />the above-captioned cases (the "applications"). <br /> <br />. 2. American Water filed timely statements of opposition <br />to each of the Board's applications. <br /> <br />3. <br />instream <br />shall be <br />terminus <br /> <br />The Board agrees that the lower terminii of the <br />flow water rights awarded in the above-captioned cases <br />the following points, notwithstanding any other lower <br />specified in the pending applications I <br /> <br />a. In Case No. 89CW22, the lower terminus of the <br />instream flow water right on Willow Creek shall be <br />the current location of the measuring flume installed <br />by American Water. <br /> <br />b. In Case No. 89CW23, the lower terminus of the <br />instream flow water right on Cottonwood Creek shall <br />be approximately one-quarter mile downstream from the <br />current location of the measuring flume installed by <br />American Water, at the point where American Water <br />currently diverts the flow of Cottonwood Creek in <br />connection with its ranching operations. <br /> <br />c. In Case No. 89CW24, the lower terminus of the <br />instream flow water right on South Crestone Creek <br />shall be the current location of the measuring flume <br />installed by American Water. <br /> <br />4.. The Board agrees that the decretal findings in the <br />above-referenced cases shall state that there is insufficient <br /> <br />5716.H <br /> <br />-1- <br />
