The legal description of the structure: <br /> <br />The natural stream channel from the headwaters at <br />latitude 38 deg. 00'27"N and longitude 105 deg. <br />36'50"W as the upstream terminus and extending to a <br />point at latitude 37 deg. 59'OO"N and longitude 105 <br />deg. 42'07"W as the downstream terminus, which point <br />is currently the location of the measuring flume <br />installed by AWDI, being a distance of approximately <br />6.2 miles. This segment can be located on the Horn <br />Peak, Rito Alto Peak, and Crestone U.S.G.S. <br />quadrangles. <br /> <br />For administrative purposes only, the Division Engineer has <br />translated these legal descriptions of the stream termini into <br />approximate protracted section, township, and range location from <br />U.S.G.S. mapping as follows: <br /> <br />upstream terminus being in the SE/4, sec. 2, T43N, <br />R12E, N.M.P.M.; downstream terminus being in the <br />NE/4, SE/4, NE/4, sec. 13, T43N, RIlE, N.M.P.M., <br />1700' FNL, I' FEL, or, in the alternative, NE/4, <br />SW/4, SE/4, sec. 31, T2N, RIE, Baca Grant Survey, <br />1321' FEL, 1000' FSL. <br /> <br />The court finds that there is insufficient water available to <br />preserve the natural environment to a reasonable decree in the <br />stream reach between the downstream terminus identified by this <br />paragraph (7) and the downstream terminus originally identified <br />in paragraph (3) of the application (the confluence with North <br />Crestone Creek at latitude 37 deg. 58'42"N and longitude 105 deg. <br />43'34"W). <br /> <br />8.
