9. Pursuant to the decree in Case No. 1636 of the District
Court of the Eleventh Judicial District entered on May 22, 1913,
objector, Town of Fairplay may change the point of diversion of
town of Fairplay Ditch No.2 at any time to any convenient point
or points in the immediate vicinity of said town. Applicant,
Colorado Water Conservation Board, may not object to such changes
and recognizes that changes pursuant to the decree entered in
Case No. 1636 are senior to the water rights decreed herein.

10. The priority herein awarded to maintain a minimum stream
level in said Middle Fork of the South Platte River was filed in
the water court in the year 1980 and shall be administered as
having been filed in that year; and shall be junior to all prior-
ities filed in previous years. As between all rights, filed in
the same calendar year, priorities shall be determined by histor-
ical dates of appropriation and not affected by the date of entry
of this ruling.

IT IS FURTHER ORDERED that the applicant shall insball and
maintain such water measurement devices, recording devices, con-
tent gauges and inlet and outlet measurement and recording de-
vices, as the case may be, as are deemed essential by the Office
of the State Engineer, and the same shall be installed and oper-
ated in accordance with instructions from said office.
