Pursuant to the decree in Case No. !636 of the District <br />Court of the Eleventh Judicial District entered on May 22, 1913, <br />objector, Town of Fairplay may change the point of diversion of <br />town of Fairplay Ditch No. 2 at any time to any convenient point <br />or points in the immediate vicinity of said town. Applicant, <br />Colorado Water Conservation Board, may not object to such changes <br />and recoqnizes ~hat chances rmrS1!ant. to the decre~ r:nt.~!"~(! in <br />Case No. -1636 are senior-to the water rights decreed herein. <br /> <br />10. The priority herein awarded to maintain a minimum stream <br />level in said Middle Fork of the So~th Platte River was filed in <br />the water court in the year 1980 and shall be administered I' <br />havinq been filed in that year; and shall be junior to all prior- <br />ities filed in previous years. As between all rights, filed in <br />the same calendar year, priorities shall be determined by histor- <br />ical dates of appropriation and not affected by the date of entry <br />of this ruling.
