Legal description of the stream segment through which an instream flow is <br />Claimed: The natural stream channel from the headwaters in the vicinity of latitude 390 26'29" N <br />and longitude 1060 41 '16"W as the upstream tenninus and extending to the inlet of Sylvan Lake at <br />NW/4 SW/4, Sec. 5, T7S, R83W, 6th P.M, as the downstream terminus, being a distance of <br />approximately 3.5 miles. This segment can be located on the Crooked Creek Pass U,S,G.S, <br />quadrangle. <br /> <br />b, Administration: For the stream segments in an unsurveyed area, the Division <br />Engineer has determined for administrative pUI'\Joses that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. and/or U,S.F.S, mapping is as follows: upstream <br />terminus in the SE/4, SW/4, NW/4, sec. 17, T7S, R83W, 6th P.M, <br /> <br />5, Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable degree, <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 22,1997. <br /> <br />7, Date water applied to beneficial use: Water was first applied to beneficial use on <br />September 22,1997 pursuant to S 37-92-103(4), C,R.S. (1997). <br /> <br />8, Amount of water claimed (ABSOLUTE): Instream flow of 2.50 c.f.s, (April 1 - <br />October 31); 1.75 c.f.s, (November 1 - December 31); 1.50 c,f,s, (January 1 - March 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of2.50 c,f,s. (April 1 - <br />October 31); 1.75 c,f,s. (November 1 - December 31); 1.50 c.f.s, (January 1 - March 31) is hereby <br />entered to preserve the natural environment to a reasonable degree through the upstream and <br />downstream points as described in paragraph 4 above, The appropriation date for this water right is <br />September 22, 1997. <br /> <br />The priority herein awarded was filed in the water court in the year of 1997 and shall be <br />junior to all priorities filed in previous years, As between all rights filed in the same calendar year, <br />priorities shall be determined by historical date of appropriation and not affected by the date of <br />entry of ruling. The Applicant shall install and maintain such measuring devices and keep such <br />records as the Division Engineer may require for administration of this right. <br /> <br />2 <br />
