the North ForK of the Republican River at the S 1/2. section
2, TiN. R44W, bth P.M. in Yuma County. as the downstream
terminus, a distance of approximately b.5 miles.

4. Source of water: 'hl~[_~L~~~. The water right
herein is an appropriation of surface waters of the State
of Colorauo, does not include any groundwater in the Ogallala
Aquifer and Shall not affect any diversion of designated
groundwater included within the geographic boundaries of
the Northern High Plains Designated Ground Water Basin.

5. Date of appropriation: September 10, 1975.
Water was first appl ied to beneficial use on Septemoer 10,
1975 pursuant to C.R.S. 1973, 37-92-103(4).

Amount of water: 4.0 cubic feet per second absolute.

b. Use of water: This appropriation is made pur-
suant to C.R.S. 1973. 37-92-102(31 and 37-92-103(3) and
(41. The purpose of this appropriation by the State of Colo-
rado is to insure the preservation of a minimum stream flow
in Chief CreeK to preserve the natural environment to a
reasonable degree.

7. The priority herein awarded was filed in the
water court in the year 1975 and shall be administered as
hav i ng been f i 1 ed in that year; and shall be jun.i or to all
priorities filed in previous years. As between all rights.
filed in the same calendar year, priorities shall be deter-
mined by historical dates of appropriation and not affected
by the date of entry of rul ing.
