Date of initiation of appropriation: January 23, 2002: <br /> <br />b, Date water applied to beneficial use: Water was first applied to beneficial <br />use on January 23, 2002 pursuant to S 37-92-103(4), C.R.S. (2001). <br /> <br />c. How appropriation was initiated: The Board's intent to appropriate was <br />formed and acted upon at its regular meeting on January 23, 2002. A resolution directing <br />the staff to publicly notice the Board's intent to appropriate this water right was passed by <br />the Colorado Water Conservation Board at its regular meeting on January23, 2002. <br /> <br />5. Amount of water claimed (ABSOLUTE): Instream flow of 11.3 cfs (May 1 - <br />October 31); 10.4 cfs (November I-April 30). <br /> <br />6. Remarks: This appropriation is made pursuant to the provlSlons of <br />SS 37-92-102(3) and 37-92-103(3), (4) and (10), C.R.S, (2001). The purpose of this <br />appropriation by the State of Colorado is to preserve the natural environment to a reasonable <br />degree. The Board has made the determination that the natural environment will be <br />preserved to a reasonable degree by the water available for the appropriation to be made; <br />that there is a natural environment that can be preserved to a reasonable degree with the <br />Board's water right herein, if granted; and that such environment can exist without material <br />injury to water rights.
