Ap~l icant a~rees to subordinate the water rights <br />herein ~o any water right for irrigation or for storage for <br />irrigation use so lung as said water right continues to be <br />used for irri~ation in Jackson County. Colorado and so long <br />as said water right will not ca~se more than 145.000 acres <br />to ~e placed under irrigation in Jackson County or cause <br />more than 17,000 acre-feet of water to De stored in Jackson <br />County for purposes of irri~ation from the North Platte <br />River ana its tributaries between October 1 of any year and <br />September 30 of the follOwing year. The applicant is not <br />bound by this stipulation if said water right is no longer <br />used for purposes of irri~ation. <br /> <br />2. If. due to chan~e in type of use of a water <br />rignt. acreage is removed from irrigation. any water right <br />subsequently used for irrigation of acreage so removed shall <br />not C~ suojec~ to tne terms of this stipulation. <br /> <br />3. Ap~licant does not waive its right to use the <br />water right herein as a basis to object to any water right <br />appl ication. plan for ausmentation. excnange. or change in <br />use or point of diversion not in furtherance of provision <br />~o. 1 of this sti~ulation. <br /> <br />4. The p~rpose of this stipulation is to allow <br />full compl iance with th~ equitable apportionment provisions <br />of ~eQLa~~g_~L_aXQmiQg. j~5 U.S. 5Bq (lq45) and mOdified <br />January 14. 1~53. Appl icant has entereo into a stipulation <br />witn the Jackson County Water Conservancy District due to <br />the uniqueness of said equitable apportionment decree in <br />tnat said decree defines the speCific acreage that may be <br />placed under irrigation. Tnis stipulation establishes no <br />general ~rincjple or precedent with respect to any other <br />interstat~ stream. <br /> <br />The Colorado River Water Conservation District.
