The usJ of the water is to appropriate such mini- <br />m~m stream flows a~ are required to preserve the natural <br />environment to a r~asonable degree. <br />I <br /> <br />1. The da~e of initiation of appropriation is Janu- <br />ary 19, 1977. I <br /> <br />8. The amJunt of water claimed is: <br />of water per secon1 of time. <br /> <br />9. The watler was first app1 ied to the above benefi- <br />cial use on JanUar119, 1977 by action of the Colorado Water <br />Conservation Board fnder the provisions of C.R.S. 1973, <br />37-92-102(3), 37-92rl03(3), (4) and (10). <br />I <br />10. This aplpropriation is made under the provisions <br />of C.R.S. 1973. 37-192-102(3)' 37-92-103(3), (4) and (10), <br />known as Senate bill 97, signed into law, April 23, 1973. <br />I <br />11. Stateme!nts of opposition were timely filed by <br />the Colorado River ~a~er Conservation District. the Middle <br />Park Water Conserva cy District. and the United States of <br />Amer;ca and as a result. on ----~~6t~l-!I'~~------. <br />tne appl ication was rereferred T. the Water Judge for Water <br />Division No.5. <br /> <br />1 cubic '"ok. <br /> <br />12. The statements of opposition of the Colorado ~,.r~ <br />Water Conservation District and the Middle Park Water Conser- <br />vancy District were subsequently withdrawn and the statement <br />of opposition of th United States of America was withdrawn <br />by stipulation, the pertinent parts of which are included <br />in this rul ing of t e referee. As a result, the appl ication <br />has agai n been refe:rred to the oJater ~efere.e by the &Jater <br />:fudge for Water Oi~ision No.5. <br />I <br />f <br />The referee dpes therefore conclude that the above-entitled <br /> <br />appl ication should be granted and that 1 cubic f~ of water <br />per second of time ~ hereby awarded for the purpose of <br /> <br />maintaining a minim m stream flow as required to preserve <br /> <br />the natural environ ent to a reasonable degree on Squaw <br /> <br />Creek between the b ginning and end points as described in <br /> <br />paragraph 5 above. <br />19. 1977, absolutel <br /> <br />ith an appropriation date of January <br /> <br />and unconditionallyi subject, however, <br /> <br />to the following stipulated agreement: <br /> <br />a.
