<br />. <br /> <br />T ". <br /> <br />- <br />e:' <br /> <br />.- <br /> <br />~ <br /> <br />STIPULATION A~O AGREEMENT <br />------------------------- <br /> <br />The Rio Grande water Users Association (the "Water <br />users") and the Colorado Aater Conservation 80ard (the "board") <br />enter into the followin~ stipulation and agreement in <br />recognition of the ne~d to integrate two goals of the State <br />of Colorado: (1) to provide flexibility in order to maximize <br />the beneficial ~se Colorado can make of the waters of the <br />Rio Grande available for use by Colorado under the Rio Grande, <br />Co.pact and (l) the establishment and exercise of water <br />rights obtained for the pJrpose of preserving the natural <br />environ~ent to a reasonable degree. <br /> <br />RECITALS <br />-------- <br /> <br />A. The ~io Grande Compact (the "co~Pdct"I' C.R.S. <br />117j. 37-bb-I)I. imposes a duty on the State of Colorado to <br />dallver Ndter in the Riu Grande at the Colorado-New Mexlco <br />state lin~. 'd~inistration of wilter rights on the Rio ~rande <br />~dinstem In C~lorado to a~SJre compliance with.the compact <br />obligJtions hdS resulted in cJrtailments of div?rsions of I <br />water fro~ the Rio Grande. and nas restricted the use of <br />variOJS Rio Grande Reservoirs. <br /> <br />a. The Water Users and the board recognize that <br />the State of Colorado has a co~plex taSk in administering <br />the Riu Grande i1nd its tribut,Hies in order to meet th'e Obli- <br />gations ialpuse~ by the ulalpact. This task is complicated <br />by the terms of the stay of proceedings in !~~~~_tQ~_~t~ <br />;;!eldco v. Colurado. 391 \J.S. 901 (19b8)'. <br />----------------- <br /> <br />C. In order to minimize the burdens of compact <br />adminiStration. there is a need to retain flexibility con- <br />cerning the u.e of Rio Grande waters within ColoradO. <br /> <br />D. Purs...ant to C.R.S. 1973.' 37-92-102(3). as amended. <br />the board is vested With authority on behalf of the People <br />of the )t~te ~f Colorado. to appropriate or acquire SuCh <br />waters of natural streams and lakes as may be required to <br />preserve the natural environment to a reasonable degree. <br />The board established water rights (herein "said water rightS") <br />to preserve the natural environment to a reasonable degree <br />witn respect to certain streams in Water Jivision No. 3 <br />wit~ an appropriation date of August lb. 1982. <br /> <br />!\jOW. THEREFORE. in consideration of the foregoing. it <br />is agreed by and bet"een the water Jsers a:'ld the ~oard as <br />f"ll o..s: <br /> <br />1. This stipul3tion and agreement shall apply only <br />
