The natural stream channel from the headwaters of Cornet Creek at <br />latitude 370 57' 41" N and longitude 107047' 31" W as the upstream <br />terminus and extending to the San Miguel River at latitude 370 56' 33" <br />N and longitude 1070 50' 08" Was the downstream terminus, being a <br />distance of approximately 3.9 miles. This segment can be located on <br />the Telluride U.S.G.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus ~ NE NW S30 T43N R8W NMPM <br />2819' East of West Section Line 990' South of North Section Line <br />UTM 4205213 N 254732 E (unsurveyed area) Zone 13 <br />Lower Terminus ~ NE SW S35 T43N R9W NMPM <br />1418' East of West Section Line 1649' North of South Section Line <br />UTM 4203227 N 250819 E (unsurveyed area) Zone 13 <br /> <br />5. Use ofthe water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br /> <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of3.5 cfs (May I - <br />May 3 I), 9.0 cfs (June I - June 30), 3.5 cfs (July I - July 31), and 0.85 cfs (Aug. I - Apr. <br />30). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of3.5 cfs <br />(May I - May 31), 9.0 cfs (June I - June 30), 3.5 cfs (July I - July 31), and 0.85 cfs <br />(Aug. 1 - Apr. 30) is hereby entered to preserve the natural environment to a reasonable <br />degree through the stream segment described in paragraph 4 above. The appropriation <br />date for this water right is January 25, 2005. <br /> <br />The priority herein awarded was filed in the water court in the year of2005 and <br />shall be junior to all priorities filed in previous years.
