South Clear Creek, t~ibutary to Clear Creek, a 'tribu-
tary to the Rio Granoe.

4. Legal description of the stream segment through which
an instream flow is claimed.

The natural stream channel from the headwaters
in the NE/4 SE/4, SeC. 34, T41N, R4W, N.M.P.M.
as the upstream terminus and extending to the
inlet of Upper Hermit Lake in the SW/4 NW/4,
Sec. 25, T41N, R4W, N.M.P.M., as the downstream
terminus, being a distance of approximately 1.9
miles. This segment can be located on the Finger
Mesa U.S.G.S. quadrangle.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

March 9, 1994.

7. The water was first applied to the above beneficial use
on March 9, 1994, by action of the Colorado Water Conservation
Board under the provision of C.R.S. (1990) ~~ 37-92-102(3),
37-92-103 (3), (4), and (10).

THE WATER REFEREE RULES:

The application is granted and a decree (ABSOLUTE) in the
amount of 1.0 c.f.s. (April 1 - October 15); 0.5 c.f.s. (October
16 - March 31) is entered to preserve the natural environment to
a reasonable degree through the upstream and downstream points as
described in paragraph 4 above. The appropriation date for this
water right is March 9, 1994.

The priority herein awarded was filed in the water court in
the year of 1994 and shall be junior to all priorities filed in
previous years. As between all rights filed in the same calendar
year, priorities shall be determined by historical date of
appropriation and not affected by the date of entry of ruling.

2
