The natural stream channel from confluence East Beaver Creek in SE 1/4 SW1/4 Sec. 12, T47N, RIW, NMPM as the upstrek terminus and extendingtoBLM Boundary in SE 1/4 SW 1/4 Sec. 32, T49N, Rl W, NMPM as the downstream terminus, being a distance of approximately 13.3 miles. This segment can be located on the Spring Hill Creek, Iris NW, Big Mesa, and McIntosh Mountain U.S.G.S. quadrangles. See Exhibit A. 5. Use of water: To preserve the natural environment to a reasonable degree. 6. Date of initiation of appropriation: May 11, 1998 7. The water was first applied to the above beneficial use on May 11, 1998, by action of the Colorado Water Conservation Board under the provision ofC.R.S. S S 37-92-102(3),37-92-103(3), (4), (10). 8. Amount of water claimed (ABSOLUTE): Instream flow of2.S c.f.s. (April 15 - July 31); 1.2 c.f.s. (August 1 - October 31); 0.7 c.f.s. (November 1 - April 14) THE WATER REFEREE RULES: The application is granted and a decree in the amount of (ABSOLUTE) Instream flow of2.S c.f.s. (April 15 '-July 31); 1.2 c.f.s. (August 1- October 31); 0.7 c.f.s. (November 1 - April 14) is hereby entered to preserve the natural environment to a reasonable degree through the upstream and downstream points as described in paragraph 4 above. The appropriation date for this water right is May 11, 1998. The priority herein awarded was filed in the water court in the year of 1998 and shall be junior to all priorities filed in previous years. As between all rights filed in the same calendar year, priorities shall be determined by historical date of appropriation and not affected by the date of entry of ruling. The Applicant shall install and maintain such measuring devices and keep such records as the Division Engineer may require for administration of this right. . It is ORDERED that this Ruling shall be filed with the water clerk subject to judicial review. 2
