The source of the wateris: <br /> <br />Cache Creek, tributary to the Arkansas River. <br /> <br />4. <br />claimed. <br /> <br />Legal description of the stream segment through which an instream flow is <br /> <br />The natural s1;ream channel from the confluence of an unnamed tributary at <br />latitude 390 02' 04''N and longitude 106020' 10"W as the upstream terminus and <br />extending to the confluence of the Arkansas River in the SE SW, Sec. 31, Tll S, <br />R79W, 6th PM as the downstream terminus, being a distance of approximately <br />4.4 miles. This segment can be located on the Granite U.S.G.s. quadrangle. <br /> <br />For the stream segments in an unsurveyed area, the Division Engineer has <br />determined for administrative purposes that the approximate legal description of <br />the instream flow termini as protracted from U.S.G.S. and/or U.S.F.S.. mapping <br />is as follows: upstream terminus in the NW NE, Sec. 4, Tl2S, R80W, 6th P.M., <br />at a point 4000 feet from the soutl;1 section line and 2200 feet from the east <br />section line. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable. degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />January 29, 1998. <br /> <br />7. The water was first applied to the above beneficial use on January 29, 1998, by <br />action of the Colorado Water Conservation Board under the provision ofC.R.S. SS 37-92-102(3), <br />37-92-103(3), (4), (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 3.0 c.f.s. (May 1- <br />Sept. 14); 1.50 c.f.s. (sept. IS-November 30); 1.0 c.f.s.
