There is no point of diversion as such, and none is claimed. The minimum stream flow right claimed is in the watershed of the Rio Grande, from its headwaters in vicinity of lat. 37 deg. 26'07" N, long. lOb deg. 42'34" W as the upstream terminus and confluence Park Creek at lat. 37 deg. 30'18" N, long. lOb deg. 42'07;; as the down- stream terminus, being a distance of approKimately 2.6 miles. This segment can be located on the Elwood Pass, Beaver Creek Ras. U.S.G.S. quadrangle. d. There is no means of diversion, the claim being to a minimum stream flow of (S-May 1 thru Sept. 30; ii-Oct. 1 thru April 30) 1 c.f.s. cubic feet/second of water per second of time, in place in the stream bed. e. The date of Initiation of such appropria- tion pursuant to the action of applicant under the provision of C.R.S. 1913, 37-92-102(3), and 31-92-103(3), (41 and (10) is July 8, 1980, on which date the water of said stream was first applied to beneficial use to maintain the minimum stream flow required to preserve the natural environment to a reasonable degree. f. That appl icant is entitled to an absolute in place minimum stream flow water right for such beneficial use with a priority date of July 8, 1980.
