Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the outlet of <br />Bill Moore Lake at latitude 39048'14"N and <br />longitude 105042'33"W as the upstream termi- <br />nus and extending to the confluence of Clear <br />Creek at latitude 39045'52"N and longitude <br />105036'04"W as the downstream terminus, being <br />a distance of approximately 6.9 miles. This <br />segment can be located on the Empire and <br />Central City U.S.G.S. quadrangles and is <br />depicted on Exhibit A. <br /> <br />For the stream segments in an unsurveyed <br />area, the Division Engineer has determined <br />for administrative purposes that the approxi- <br />mate legal description of the instream flow <br />termini as protracted from U.S.G.S. and/or <br />U.S.F.S. mapping is as follows: upstream <br />terminus in the SE/4 NE/4, Sec. 7, T3S, R74W, <br />6th P.M.; downstream terminus in the NW/4 <br />NE/4, Sec. 30, T3S, R73W, 6th P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 6, 1995. <br /> <br />7. The water was first applied to the above beneficial use <br />on Nov. 6, 1995, by action of the Colorado Water Conservation <br />Board under the provision of C.R.S. ~~ 37-92-102(3), <br />37-92-103 (3), (4), (10) . <br /> <br />8. Amount of water claimed (ABSOLUTE): <br />4.75 c.f.s. (April 15 - Aug. 15); 3.25 c.f.s. <br />15); 1.00 c.f.s. (Sept. 16 - April 14). <br /> <br />Instream flow of <br />(Aug. 16 - Sept. <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 4.75 c.f.s. (April 15 - Aug. 15); 3.25 c.f.s. (Aug. 16 <br />-Sept. 15); 1.00 c.f.s. (Sept. 16 - April 14) is hereby entered <br />to p~eserve the natural environment to a reasonable degree <br />through the upstream and downstream points as described in <br /> <br />2 <br />
