Legal description of the stream segment through which an instream flow is <br />claimed: The natural stream channel from the outlet of Leeman Lakes at latitude 390 26'43" N and <br />longitude 1060 43'12"W as the upstream terminus and extending to the confluence of West Brush <br />Creek at latitude 390 28' 01" N and longitude 106043' 33"W as the downstream terminus, being a <br />distance of approximately 2.1 miles. This segment can be located on the Crooked Creek Pass <br />U.S.G.S. quadrangle. <br /> <br />b. Administration: For the stream segments in an unsurveyed area, the Division <br />Engineer has determined for administrative purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. and/or U.S.F.S. mapping is as follows: upstream <br />terminus in the NE/4, NE/4, SW/4, sec. 13, T7S; R84W, 6th P.M.; downstream terminus in the <br />NE/4, NW/4, NW/4, sec. 12, T7S, R84W, 6th P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 22, 1997. <br /> <br />7. Date water applied to beneficial use: Water was first applied to beneficial use on <br />September 22,1997, pursuant to S 37-92-103(4), c.R.S. (1997). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow 00.75 c.f.s. (May I - July <br />31); 1.75 c.f.s. (August 1 - September 14); 0.60 c.f.s. (September 15 - April 14); 1.75 c.f.s. (April <br />15 - Apri130). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 3.75 c.f.s. (May 1 - <br />July 31); 1.75 c.f.s. (August 1 - September 14); 0.60 c.f.s. (September 15 - April 14); 1.75 c.f.s. <br />(April 15 - April 30) is hereby entered to preserve the natural environment to a reasonable degree <br />through the upstream and downstream points as described in paragraph 4 above. The appropriation <br />date for this water right is September 22, 1997. <br />
