6. That on October 31, 1979, the case was ,remanded to the undersigned Water' Referee for investigation and ruling thereon. 7. 'That the Application herein concerns a claim made pursuant to the provisions, of C.R.S. 1973, 37-92-102(3) and C.R.S. 1973, 37-92-103(3), (4) and (10) known as Senate Bill 97, and that the purpose of the appropriation claimed herein by the State of Colorado is to insure the preservation of a minimum stream level to protect the natural environment to a reasonable degree. 8.That Applicant has furnished acceptable proof as to claims made. LOCATION OF POINT OF DIVERSION: The natural stream channel trom headwaters 1n v1c1nity of lat 38 02 48 long 105 36 42 as the upstream terminus and FS boundary S9 T44N R73W 6PM as the downstream terminus, being a distance of approxi- mately 4 miles. This segment can be located on the Horn Peak U.S.G.S. quadrangle. DESCRIPTION OF DITCH AND/OR PIPELINE (MEANS OF DIVERSION): Notapphcable. SOURCE OF WATER: Hiltman Creek, a natural stream in the watershed ot Grape Creek. PRIORITY DATE: March 14, 1979, provided, however, that this r1ght shall be junior to all priorities awarded in cases filed prior to 1979, and otherwise junior as provided, in C.R.S. 1973, 37-92-306.
