The source of the water is: Cottonwood Creek <br /> <br />4, Legal description of the stream segment through which an instream flow is <br />claimed: <br /> <br />The natural stream channel at the confluence of the Slaughter Spring Gulch at <br />latitude 390 32' 11" N and longitude 1070 02' 15" Was the upstream terminus and <br />extending to the headgate of the Anderson Ditch at latitude 390 34' 02" N and <br />longitude 1070 02' 09" W as the downstream terminus, being a distance of <br />approximately 2,2 miles. This segment can be located on the Cottonwood Pass <br />U.S.G.S. quadrangles. <br /> <br />For administrative purposes only: <br />Upper Terminus := NW NW SEC 15 TWN 6S RNG 86W 6PM <br />660' East of West Section Line & 920' South of North Section Line <br />VTM 43 78 076N 13 3 24 897E <br />Lower Terminus:= SE SE SEC 33 TWN 5S RNG 86W 6PM <br />1340' West of East Section Line & 880' North of South Section Line <br />UTM 4381 495N 13325 II8E <br /> <br />5, Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6, Date of initiation of appropriation: <br />January 22, 2003 <br /> <br />7. The water was first applied to the above beneficial use on January 22, 2003, by <br />the action of the Colorado Water Conservation Board under the provisions ofC.R.S. S S 37~ <br />92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 1.7 cfs (May 1 - <br />October 31) and 1.3 cfs (November 1 - April 30). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 1.7 cfs <br />(May 1 - October 31) and 1.3 cfs (November 1 - April 30) is hereby entered to, preserve the <br />natural environment to a reasonable degree through the stream segment described in <br />paragraph 4 above. The appropriation date for this water right is January 22,2003. <br /> <br />The priority herein awarded was filed in the water court in the year of 2003 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling, The Applicant shall install and maintain such <br /> <br />2 <br />
