UNIVERSAL ASHRAM,IN SAGUACHE COUNTY, <br /> <br />and <br /> <br />CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE COLORADO WATER <br />CONSERVATION BOARD, IN SAGUACHE COUNTY. <br /> <br />The Colorado Water Conservation Board ("CWCB"), applicant in <br />Case No. 89CW21 and objector in Case No. 89CW9, and the Haidakhandi <br />Universal Ashram ("Ashram"), applicant in Case No. 89CW9 and <br />objector in Case No. 89CW21, through their respective attorneys, <br />hereby stipulate and agree as follows: <br /> <br />WHEREAS, the CWCB filed an application in CaseNo. 89CW21 for <br />instream flow water rights on Spanish Creek pursuant to <br />37-92-102(3), C.R.S. (1973 and 1988 supp.), to preserve the natural <br />environment to a reasonable degree, claiming an appropriation date <br />of May 11, 1989, to which application the Ashram filed a statement <br />of opposition, and . <br /> <br />WHEREAS, the Ashram filed an application in Case No. 89CW9 for <br />a surface water right on Spanish Creek, claiming an appropriation <br />date of March 20, 1989, to which application the CWCB filed a <br />statement of opposition: <br /> <br />1. The CWCB agrees to withdraw its statement of opposition <br />in Case No. 89CW9 effective if, and only if, the Ashram withdraws <br />its statement of opposition in Case No. 89CW21. <br /> <br />2. The Ashram agrees to withdraw its statement of opposition <br />in Case No. 89CW21 eftective if, and only if, the CWCB withdraws <br />its sta~t of opposition in Case No. 89CW9. <br /> <br />3. The parties to this stipulation shall execute and file <br />said withdrawals within seven days of the filing of the Stipu- <br />lation with the Court. <br /> <br />-- <br /> <br />j 8 <br />.
