RULING OF REFEREE

Pursuant to Order of Referral filed and entered in

the above case on August 15, 1980~ the undersiened Water

Referee, having investigated the matter of the Application

on file herein, hereby makes the following findings and

ruling thereon:

FINDINGS OF FACT

1. That the said Application was filed on August 15, 1980.
2. That the Water Clerk caused publication of such filing

as provided by statute; that the time fo~ filing Statements of

Opposition expired on the last day of October, 1980, and that

one such statement lias been filed by John R. Hill, Jr., Trial

Attorney, on behalf of the United" States of America.

"3. That the said Application concerns an appropriation

claimed pursuant to C.R.S. 1973, 37-92-102(3) and 37-92-103

(3)(4) and 110) known as Senate. Bill 97.

4. That on November 21, 1980, the undersigned Water
Referee re-referred the case to the Water Judge.
5. That the Applicant and .the United States of America
filed a Stipulation in the matter on November 25, 1930.
