The natural stream channel from the headwaters of East Fork <br />Escalante Creek at latitude 380 28' 32" N and longitude 1080 29' IT' <br />Was the upstream terminus and extending to the confluence of Middle <br />Fork Escalante Creek at latitude 380 34' 55" N and longitude 1080 24' <br />21" W as the downstream terminus, being a distance of approximately <br />9.8 miles. This segment can be located on the Kelso Point and <br />Starvation Point U.S.O.S. quadrangles. <br />b. For administrative purposes only: <br />Upper Terminus = SW SE S25 T49N R15WNMPM <br />1697' West of East Section Line 638' North of South Section Line <br />UTM 4264383 N 195685 E Zone 13 <br />Lower Terminus = NW SW S23 T50N RI4W NMPM <br />866' East of West Section Line 2069' North of South Section Line <br />UTM 4275896 N 203305 E Zone 13 <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 25, 2005. <br /> <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />9937-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 2.5 cfs (Mar. 1 <br />- Mar. 31), 3.9 cfs (Apr. 1 - June 14),2.7 cfs (June 15 - July 31), and 1.1 cfs (Aug. 1- <br />Feb. 28). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of2.5 cfs <br />(Mar. 1 - Mar. 31), 3.9 cfs (Apr. 1 - June 14),2.7 cfs (June 15 - July 31), and 1.1 cfs <br />(Aug. 1 - Feb. 28) is hereby entered to preserve the natural environment to a reasonable <br />degree through the stream segment described in paragraph 4 above. The appropriation <br />date for this water right is January 25, 2005. <br /> <br />The priority herein awarded was filed in the water court in the year of 2005 and <br />shall be junior to all priorities filed in previous years.
