The natural stream channel from the headwaters of East Fork <br />Escalante Creek at latitude 380 28' 32" N and longitude 1080 29' 17" <br />W as th,~ upstream terminus and extending to the confluence of Middle <br />Fork Escalante Creek at latitude 380 34' 55" N and longitude 108024' <br />21" W as the downstream terminus, being a distance of approximately <br />9.8 miles. This segment can be located on the Kelso Point and <br />Starvation Point U.S.G.S. quadrangles. <br />b. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of C.R.S. <br />9 ~ 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of2.5 cfs (Mar. I <br />_ Mar. 31), 3.9 cfs (Apr. 1 - June 14), 2.7 cfs (June 15 - July 31), and 1.1 cfs (Aug. I - <br />Feb. 28). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of2.5 cfs <br />(Mar. I-Mar.31),3.9cfs(Apr. I-June 14), 2.7 cfs (June 15-July31),and 1.1 cfs <br />(Aug. I - Feb. 28) is hereby entered to preserve the natural environment to a reasonable <br />degree through the stream segment described in paragraph 4 above. The appropriation <br />date for this water right is January 25, 2005. <br /> <br />The priority herein awarded was filed in the water court in the year of 2005 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />
