All notIces required oy <br />law for the filin':j of this application have been fulfilled. and <br />the COJrt has jurIsdiction over the application. <br /> <br />A statement of opposition was timely filed by Frank L. <br />Smith and Jeanne C. Smith. No other statements of opposition <br />were filed and the time for filing same has elapsed. Counsel for <br />Frank and Jeanne Smith subsequently filed a Motion to Withdraw <br />Opposition. which motion was granted by this court on October . <br />1985. <br /> <br />All matters contained in the application have been reviewed <br />and testimony taken where SuCh testimony is necessary and the <br />court finds that the statements contained in the application are <br />true and that applIcant IS entitled to the water right requested <br />in the application. <br />
