<br />CONSERVATION BOARD ON BEHALF OF THE PEOPLE OF THE STATE OF COLORADO, IN THE
<br />COLORADO RIVER, OR ITS TRIBUTARIES, TRIBUTARY INVOLVED: GOLD RUN, IN GRAND
<br />COUNTY

<br />The above entitled Application was filed on December 31, 1985, and was
<br />referred to the undersigned as Water Referee for Water Division No.5, State
<br />of Colorado, by the Water Judge of said Court on the 7th day of January, 1986,
<br />in accordance with Article 92 of Chapter 37, Colorado Revised Statutes 1973,
<br />known as The Water Right Determination and Administration Act of 1969.
<br />
<br />On April 11, 1986, the Claimant filed an amended application of Case No.
<br />85CW630. On May 12, 1986, the Court approved the Motion to Amend.
<br />
<br />And the undersigned Referee having made such investigations as are
<br />necessary to determine whether or not the statements in the amended
<br />Application are true and having become fully advised with respect to the
<br />subject matter of the Amended Application does hereby make the following
<br />determination and Ruling as the Referee in this matter, to-wit:

<br />The statements in the Amended Application are true.
<br />
<br />2. The name of the stream involved is Gold Run.
<br />
<br />3. The name and address of the Claimant: Colorado Water Conservation
<br />Board; 1313 Sherman Street, Suite 721; Denver, Colorado 80203.
<br />
<br />4. The source of the water is Gold Run, tributary to Willow Creek,
<br />tributary to the Colorado River.
<br />
<br />5. Description of beginning and end points of minimum stream flow
<br />claimed: The natural stream channel from its headwaters in the N~/4SEl/4 of
<br />Section 3, T. 3 N., R. 77 W. of the 6th P.M. at Lat. 40"14' 52" N., Long.
<br />~106"00'08" W. as the upstream terminus, and extending to the confluence with
<br />Willow Creek in the SWl/4NWl/4 of Section 34, T. 3 N., R. 77 W. of the 6th
<br />P.M. at Lat. 40"10'52" N., Long. 106"00'30" W. as the downstream terminus.'

<br />6. The use of the water is to appropriate such minimum stream flows as
<br />are required to preserve the nitura1 environment to a reasonable degree.
<br />
<br />7. The date of initiation of appropriation is November 8, 1985.
<br />
<br />8. The amount of water claimed is 1.0 cubic feet of water per second of
<br />time, absolute.
