The source of the water is: <br /> <br />Middle Fork San Francisco Creek, tributary to San <br />Francisco Creek, a tributary to the Rio Grande. <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the headwaters <br />in the vicinity of latitude 37030'42"N and <br />longitude 106024'49"W as the upstream terminus <br />and extending to the confluence of West Fork San <br />Francisco Creek at latitude 37033'21"N and longitude <br />106023'38"W as the downstream terminus, being a <br />distance of approximately 3.2 miles. This segment <br />can.be located on the Horseshoe Mountain V.S.G.S. <br />quadrangle. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from V.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SE/4 NW/4, Sec. 27, T38N, R5E, N.M.P.M.; <br />downstream terminus in the SE/4 NW/4, Sec. 11, T38N, <br />R5E, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />!nstream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on March 9, 1994, by action of the Colorado Water Conservation <br />Board under the provision of C.~.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />4.5 c.f.s. (April 15 - July 31); 2.5 c.f.s. (August 1 - November <br />30); 1.75 c.f.s.
